General Terms & Conditions
These terms regulate all users of all content of the domain ferm-living.com. The Terms and Conditions will be valid for all your future transactions with ferm LIVING (henceforth: ferm LIVING may be referred to as ’us’) and visits to the site.
ferm LIVING reserve the right to revise these terms and conditions. The date of the latest update is found in the final section of the Terms and Conditions. Users are responsible for keeping themselves updated with such changes.
Disclaimer
We do not guarantee that all the items available at the ferm LIVING web shop are in stock at the time of your order.
ferm LIVING cannot warrant that the content of the site is at all time free of inaccuracies or typographical errors. Neither can we guarantee that all information is up-to-date. ferm LIVING may at any time change the content of the site.
Though ferm LIVING strive to always display the correct texts, images and pricing on the site and web shop, errors can occur. If you have been charged the wrong amount when shopping from the web shop, we will give you the option of placing a new order with the correct price or canceling your order. If we are unable to get in touch with you, your order will be automatically cancelled.
Part of the services mediated through the site are performed and concerned for by outside organizations. In situations where ferm LIVING act as agent for such services, we cannot be held responsible for any errors resulting from their activities.
ferm LIVING cannot be held responsible for any damages caused from using the site or for that matter not being able to use the site. ferm LIVING cannot guarantee a problem-free uninterrupted and secure access to the site.
We cannot guarantee that colours in the website are fully equivalent to the items’ actual colors. This depends partly on the colour settings of your computer and monitor.

Privacy Policy
All personal information saved at the site will be handled with most care. The information that we store will not be sold or used for any purposes other than making sure you get the best service possible. It will solely be used for informing you about special offers and other marketing activities related to the different units of ferm LIVING. When registering to the site, you have the option not to receive any information from ferm LIVING. If you wish to end your subscription to information from ferm LIVING, you may make the changes in your account settings or send an email to shop@ferm-living.com. State your name and email address and a short description of the matter in the email message.
At all times you have the right to know what information is kept about you in our systems. This information can be requested by sending an email to shop@ferm-living.com. If the information is incomplete or incorrect, you have the right to have the information corrected or deleted.
All customers paying by card are subject to validation checks. ferm LIVING make the reservation to delay any order if we suspect a further security control is needed.
Security
ferm LIVING use Secure Socket Layers (SSL), the industry standard in transferring information to process your orders. ferm LIVING web shop uses the Thawte SSL Certificates to offer secure communications by encrypting all data to and from the site. When placing an order, you can immediately check the security validity by clicking the Thawte icon at checkout.
For security reasons, we do not store any payment information in our database.
Cookies
Cookies are used in the site in order to improve your experience of the site. The cookie identifies your computer and allows the site to remember your personal settings. Cookies are also used for statistical purposes.
You can set your browser to notify you when a cookie is to be activated. This enables you to reject usage of this cookie or to tell your browser to erase the cookie at the end of your visit. The web shop cannot be used if cookies are disallowed.
Payment & Prices
We accept card payments by Dankort, Visa/Dankort, Visa, Visa Electron, JCB, Maestro, Eurocard, MasterCard and American Express. The full amount will be charged on the date of the shipment (i.e. when the package is dispatched).
If your country is part of the European Union (EU), prices include Danish VAT at 25 %.
Shipping costs will be added to your order. For shipping charges, please view the ferm LIVING shipping table.
Orders to countries outside the EU may be subject to VAT, import duties and/or taxes, which are levied once your package reaches your country. ferm LIVING ships your package according to Incoterm Delivered Duty Unpaid (DDU), which means we do not collect VAT, duties and/or taxes on orders to countries outside the EU and we cannot predict what your particular charges may be. If you do incur any such additional charges they must be rendered in order for your package to clear customs. Please contact your local customs office for further information.
Shopping
No binding purchase agreement between you and ferm LIVING has been made until you receive an order confirmation from ferm LIVING.
Exchanges and refunds
All goods purchased at www.ferm-living.com are covered by the Danish Sale of Goods Act and there by the two-year right of complaint. Please note that defects in products, which are caused by incorrect use or misuse, are not covered by the right of complaint.
The items you wish to return mush have been handed over to a freight forwarder no later than 14 days after you received you order.
During 14 days following the delivery of your order, you may request exchange or refund of items, which you must return to us in perfect condition accompanied by the original invoice. Returns will only be accepted if labels and original packaging are fully intact. ferm LIVING cannot accept returns where labels have been removed or the package is damaged.
You are responsible for the shipping of returned items back to ferm LIVING. Items lost in transportation will not be compensated for.
Shipping charges on returned merchandise are at the customer's expense. However, ferm LIVING will not charge additional shipping on exchanges. Refunds for returned merchandise will be made to the original purchaser’s credit card within two weeks of the return of the product. Note that additional duties and/or taxes will not be refunded. Neither will shipping costs. For countries within the EU, VAT will be included in the refund.
All exchanges are subject to availability.
Faulty items will be exchanged to the same type of product in the same size, subject to availability. Refunds for faulty items can be made within the 14-day period following delivery.
Exchanges and returns can only be made as described in ferm LIVING’s instructions. Items cannot be exchanged or refunded at any of our retailers.
Please note that items bought on sale cannot be exchanged.

Deliveries
We will expedite your order as soon as possible. All orders are fulfilled at our warehouse in Herning, Denmark within 2-3 business days. All orders are subject to availability. When your order is placed we will send you an order confirmation. Once your package is shipped we will send you an email with a tracking number for the package.
Shipping Charges

Collecting Orders
All orders are shipped with Post Danmark (Danish Postal Service) or GLS (Business addresses). Orders can be tracked at www.postdanmark.dk or www.gls.dk. Once the parcel has been shipped, you will receive an e-mail with a tracking number.
Due to courier restrictions and the risk of credit card fraud we cannot deliver to PO Boxes.
Uncollected items
Shipping costs will not be refunded for uncollected or rejected items.
Force Majeure
In case of Force Majeur, ferm LIVING’s obligations are procrastinated. The contract between you and ferm LIVING can in such cases be partially or fully terminated by yourself or by ferm LIVING. A Force Majeur is in the event of war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events.
ferm LIVING will under such circumstances do everything we can to solve the matter for our customers as soon and entirely as possible.
Governing Law
These terms of use are construed in accordance with Danish law and you agree that the Danish courts will have exclusive jurisdiction for any dispute under this agreement.
The laws of your country may be different from the laws in Denmark and there may be additional legal requirements for you to use this website. You must comply with all applicable local and international laws and regulations regarding your use of our website. ferm LIVING reserves the right to seek all remedies available at law and in equity for violations of these Terms and Conditions, including the right to block access to the site. Violation of the site may be subject to prosecution.
